Violences conjugales — droits, signalement et protection
What is this for
Important points
- Good to know: En France, une personne étrangère victime de violences conjugales peut obtenir un titre de séjour indépendant de son conjoint, même si son précédent titre était lié au mariage. La loi vous protège.
Steps to follow
Step 1: In immediate danger — call 17 or 112
If you are in immediate danger, call 17 (police) or 112. If you cannot speak, send a text message to 114. The 3919 helpline (Violences Femmes Info) listens and advises you, free of charge, 24/7, but it is not an emergency number.
Step 2: Leave home if you can
If violence is about to happen, leave home with your essential documents (passport, residence permit, carte Vitale, money). Go to a hospital emergency department or a police station.
Step 3: File a complaint
You can file a complaint at any police or gendarmerie station. For violence within a couple, a simple incident report (main courante) is not possible: the police must record your complaint and cannot refuse. They give you a receipt. Bring any evidence you have (medical certificate, photos, messages).
Step 4: Protection order
The family court judge can urgently issue a protection order, even if you have not filed a complaint. It can forbid the abuser from contacting you and order them to leave the home. An association or a lawyer can help you apply.
Step 5: Residence permit for victims
If your residence permit depends on your violent partner, you can obtain a permit in your own right by proving the violence you suffered. Contact a specialised association.
